This half day seminar and workshop will address the following issue: “What changes need to be made to construction Contracts for BIFSOPA legislation and new cases in construction law?”.
The seminar and workshop will enable you to:

Understand how to amend your contract to deal with the latest BIFSOPA, QBCC amendments, new case law and the new timelines.

Discuss and understand the latest contract clauses required as a result of cases on the BCIPA, BIFSOPA, QBCC Act & PPS Act.

Understand what you can do by amending your contract to maximise your protection from dubious EOT and delay claims.

Discuss and understand the latest contract amendments dealing with conversion of security, final certificates, termination and deeds of release.

Discuss the effect of the recent decisions on latent defect claims.

Examine contract clauses dealing with:

preconditions to payment claims – are they affective anymore?

termination for convenience – a dangerous weapon;

deeds of release – will they defeat a BCIPA claim?

time bars – do they work?

warranties to purchasers and body corporates for latent defects;

conversion of security in response to an adjudication decision; and
