CDI’s role in Anthony John Group’s Southpoint development

CDI Lawyers acts for multi-award winning and internationally recognised developer, Anthony John Group, on the $600 million mixed-use, transit-oriented Southpoint development at South Bank.

 The Project

Southpoint is located at the heart of one of Brisbane’s major public transport hubs, and seamlessly integrates residential, commercial, retail and hotel uses over three architecturally unique buildings.

The Retail Precinct is comprised of a Grade A commercial office tower and a ground level retail plaza featuring shopping, bars, cafes and restaurants, around a fully restored heritage building. The retail precinct reached practical completion in October 2016 and is currently home to the head office of ASX listed Flight Centre and South Bank’s first major supermarket, Woolworths.

The Emporium Hotel and Residences is comprised of one, two and three-bedroom luxury apartments which take full advantage of Brisbane’s second boutique Emporium Hotel. The final instalment of Southpoint is The Apartments, a residential tower incorporating 192 luxury apartments.

Our Role

CDI is acting on behalf of Anthony John Group across all three stages of the Southpoint development. Our role has involved the preparation, drafting and negotiation of the design and construct head contracts and ancillary documents for all three stages.  We provided advice regarding the management of the complex interactions between the key external stakeholders, including South Bank Corporation, the statutory owner of the site, Queensland Rail, the operator of the South Bank train station, Union Investment Real Estate Australia, the German-based purchaser of the Retail Precinct, and major commercial tenants, including Flight Centre and Woolworths.

 

 

 

CDI was involved in contractual administration during construction, including responding to claims for time and cost submitted by the main contractors, preparing ancillary agreements regarding the interface between concurrent works on multiple stages and assisting with negotiation and dispute resolution, to avoid any potential disputes.

We are also advising Anthony John Group to ensure the smooth completion and conclusion of the development.

Our construction and development law expertise allowed us to work closely with Anthony John Group through all stages of the development to ensure a successful outcome. Throughout the course of the project, CDI was available on short notice to provide guidance and strategy on complex legal matters, with an emphasis on pragmatism and value-laden solutions. Our specialist advice allowed Anthony John Group to successfully navigate complex interface issues, the competing interests of numerous prominent stakeholders, and potential disputes to ensure that issues could be resolved without resort to adjudication or litigation.
