David is a Senior Associate in our Litigation & Dispute Resolution team. David advises clients in construction litigation and other dispute resolution processes to resolve contractual claims. David specialises in security of payment disputes and large scale litigation with a focus on technical engineering claims, security, defective works, unlicensed contracting and delay claims.
In addition to construction litigation experience, David also has experience in front end construction law, including pre-contract and tender negotiations, risk assessment, contract documentation and project management strategy and advice.
David has experience in:
- complex litigation relating to commercial construction contracts involving multiple parties in the District and Supreme Court of Queensland
- security of payment disputes in Queensland and NSW
- acting in proceedings upholding or challenging adjudicators’ decisions, particularly those turning on the interpretation of the Queensland Building and Construction Commission Act 1991
- the use and interpretation of major industry standard form construction contracts
- advising on, drafting and negotiating construction contracts and ancillary documents for residential, commercial, civil and infrastructure construction projects in all states of Australia
David’s key experience includes:
- acting for a developer in a multi-million dollar dispute against multiple parties for breach of contract, negligence and ACL claims concerning defective design and construction of mechanical works in relation to a large commercial development in Queensland
- acting for a developer in Supreme Court proceedings defending ACL claims with a total disputed value of over $10 million in relation to refurbishment works carried out at a shopping centre in Queensland
- the preparation and negotiation of contract documents for the development and construction, including procurement and the staging of the works for the AUD 420 million 91 storey mixed-use project at 30 Albert Street in Brisbane
