Jason specialises in advising on, drafting and negotiating construction contracts and ancillary documents for commercial, civil and industrial construction projects, both in Australia and overseas.

Jason has acted for a range of clients including developers, consultants, contractors, and subcontractors with respect to contractual matters and disputes arising during tender, construction and post-completion stages.

Jason has experience in:

  • the use and interpretation of major industry standard form construction contracts
  • the preparation of bespoke construction agreements, including deeds of guarantee, variation, warranty, release, settlement, and expert determination/arbitration agreements
  • the preparation of construction contract documentation and notices, including variation claims, extension of time claims, defect notices, notices of recourse to security as well as responses to the same
  • the preparation of integrated contract suites for principals, contractors and subcontractors
  • security for payment disputes, including preparation of payment claims, payment schedules, adjudication applications, responses and replies, in Queensland and Western Australia
  • briefing of expert witnesses, including quantity surveyors, programming consultants and geotechnical consultants
  • proceedings relating to large-scale commercial litigation and injunctive relief

Jason’s key experience includes:

  • preparation of construction contract documentation for all three Stages (A, B and C) for the design and construction of the Southpoint development, home to one of Queensland’s largest mixed-use residential/commercial developments and Brisbane’s second Emporium Hotel
  • preparation and negotiation of construction contract documentation for the design and construction of the Pullman Ibis Brisbane Airport development, comprising a 5 star Pullman Hotel, a 3.5 star Ibis Hotel and a state-of-the-art conference centre
  • acting for the claimant in security of payment applications with a total disputed value in excess of $300,000,000 in relation to the Wiggins Island Coal Export Terminal project
  • acting for the claimant in a security of payment application with a total disputed value of over $8,000,000 in relation to the Gorgon LNG Project on Barrow Island, Western Australia
  • preparation of construction contract documentation for the upgrade of the Nadi International Airport in Fiji
