CDI secures over AUD90M at adjudication for Martinus on the Moorebank Interstate Terminal

CDI Lawyers has recently acted for Martinus Rail against Qube Holdings Limited in adjudications under the Building and Construction Industry (Security of Payment) Act 1999 (NSW) arising from the Moorebank Logistics Park (MLP) Interstate Terminal in New South Wales.

The adjudications relate to a broader dispute between Martinus and Qube arising from MLP, the largest intermodal logistics precinct in Australia and a nationally significant infrastructure project. Martinus was engaged by Qube under two contracts in 2022 to deliver the interstate rail terminal and rail access.  The parties fell into dispute in 2023, leading to the adjudication and a broader dispute concerning termination, including proceedings in the Supreme Court of New South Wales (in which Martinus is separately represented).

Across multiple adjudications, CDI has successfully acted for Martinus in securing adjudication decisions for over AUD90M (including interest).

The most recent adjudication decision has been the subject of an ASX announcement by Qube.

Qube were represented by King & Wood Mallesons and Pinsent Masons.

The results reflect the specialist adjudication and engineering expertise of CDI’s team, which has seen the team act on a number of Australia’s largest and most complex adjudication disputes, including recovering over AUD200M in a series of adjudications on the Wiggins Island Coal Export Terminal for a joint venture between Monadelphous Engineering and Muhibbah (Malaysia), and defending circa AUD50M in adjudication claims on the Ichthys LNG Project for Kawasaki Heavy Industries (Japan).
